These Terms and Conditions (“Terms”) govern your use of the website at whitetigerdojo.com and the services offered by White Tiger Dojo (“White Tiger Dojo,” “we,” “us,” or “our”), a martial arts school located at 99 Industrial Rd, Berkeley Heights, New Jersey 07922.

By using this website, submitting a form, enrolling in a program, or opting in to our text message or voice communications, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the website or our services.

If you are entering into these Terms on behalf of a minor, you confirm that you are that child’s parent or legal guardian and that you accept these Terms on their behalf.

You must be at least 18 years old to submit forms on this website, enroll a student, agree to these Terms, or consent to receive text messages or automated calls from us. Students under 18 must be enrolled by a parent or legal guardian.

You agree that the information you provide to us is accurate and complete, and that you will keep it up to date — particularly emergency contact details and any medical conditions relevant to safe training.

Enrollment is subject to completion of our required forms, including the waivers available on our waivers page. Participation in class is not permitted until the applicable waivers have been signed by the student or, for a minor, by a parent or legal guardian.

• Membership plans are sold on the terms shown on our enrollment and payment page at the time of purchase, and include a set number of class credits for the plan period.
• Class credits are consumed as attendance is recorded. Conditioning classes do not consume credits.
• Class schedules are published on our schedules page. We reserve the right to alter, combine, or cancel classes, change instructors, and close for holidays, weather, or facility reasons.
• Students are expected to follow dojo rules, instructor direction, and standards of conduct and hygiene. We may suspend or terminate a membership for conduct that endangers or disrupts others, without refund of amounts already due.

Where the terms of a signed enrollment agreement or waiver conflict with these Terms, the signed agreement governs for that student.

Tuition, fees, terms, and any applicable deposit are those disclosed on the enrollment and payment page and in your signed enrollment agreement. Payments may be made by the methods we offer at the time of enrollment.

• You are responsible for paying all amounts due under your plan for its full term.
• Deposits, cancellation windows, relocation and disability provisions, late fees, and returned-payment fees are governed by the financial terms in your signed enrollment agreement.
• Card and bank details are handled by our third-party payment processor. We do not store full payment card numbers.
• Prices are subject to change. Changes do not affect the price of a plan already in its committed term.

These SMS Terms govern the White Tiger Dojo text messaging program and form part of these Terms. They apply in addition to the SMS section of our Privacy Policy.

Program description

By opting in, you agree to receive text messages from White Tiger Dojo relating to your membership and our programs. These may include class and appointment reminders, trial class confirmations, schedule changes and weather closures, billing and renewal reminders, belt testing and event notices, replies to your questions, and — where you have separately consented to marketing messages — promotional offers and announcements.

How to opt in

You may opt in by providing your mobile number and agreeing to receive text messages through the chat widget on our website, by checking the SMS consent box on a form on our website, by providing and authorizing your mobile number on a paper enrollment or waiver form, by giving verbal consent to a staff member, or by texting us first. You confirm that you are the subscriber or customary user of the number you provide, and that you are 18 or older.

Message frequency and cost

Message frequency varies depending on your enrollment status and how you interact with us. Message and data rates may apply. Any charges are billed by, and payable to, your mobile service provider. Contact your carrier for details of your plan.

Opt out and help

If you change or give up your mobile number, you agree to notify us so that we do not send messages intended for you to someone else.

Carriers and delivery

Carriers are not liable for delayed or undelivered messages. Delivery depends on your carrier’s network and your device, and we cannot guarantee that every message will be received. Supported carriers may change without notice.

Privacy

No mobile information will be sold, rented, or shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent are not shared with any third party for marketing purposes. See our Privacy Policy for full details.

We use an AI-powered voice assistant to help handle telephone calls. By calling us, or by consenting to receive calls from us, you agree to the terms in this section. Further detail on how call information is handled is in our Privacy Policy.

Recording and transcription

Calls may be recorded and transcribed for quality assurance, training, scheduling accuracy, and record-keeping. You will be notified at the start of a call that is being recorded. By continuing with the call after that notice, you consent to the recording and transcription. If you do not consent, tell us and we will continue by another means, or you may contact us by email or in person.

Automated and prerecorded calls

Where we place calls to you using an artificial, prerecorded, or AI-generated voice for a marketing purpose, we do so only with your prior express written consent, as required by the Telephone Consumer Protection Act. Consent to receive automated marketing calls is not a condition of enrollment or of purchasing anything from us. You may withdraw consent at any time by telling the assistant, telling a staff member, or contacting us.

Accuracy and limitations

• The assistant may make mistakes. Information it gives about schedules, pricing, availability, or policy is provisional and is confirmed by a person before an enrollment, payment, or schedule change is finalized.
• Nothing said by the AI assistant constitutes medical, legal, or financial advice, and it cannot vary the terms of a signed enrollment agreement or waiver.
• Where the assistant’s statement conflicts with these Terms, the published schedule, or your signed agreement, those documents govern.
• Do not use the AI assistant in an emergency. It is not monitored in real time. In an emergency, call 911.

Acceptable use

You agree not to use the AI voice assistant to harass, abuse, or deceive, to attempt to extract information about other students, or to interfere with its operation. We may discontinue automated call handling for any caller who does so.

You agree not to:

• Use the website for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorized access to any part of the site, our administrator area, our servers, or another person’s records
• Submit false information, impersonate another person, or enroll someone without authority
• Introduce malware, scrape the site by automated means, or interfere with its normal operation
• Copy, republish, or resell content from the site except as permitted below

The content on this website — including text, articles, photographs, video, curriculum descriptions, logos, and the White Tiger Dojo name and marks — is owned by White Tiger Dojo or its licensors and is protected by copyright and trademark law. You may view and print content for your own personal, non-commercial use. Any other reproduction, distribution, modification, or commercial use requires our prior written permission.

Martial arts training is a physical activity that carries an inherent risk of injury. Participation is conditional on signing our waivers, which include an assumption of risk and release of liability, financial terms, and, for applicable programs, additional program-specific waivers. These are available on our waivers page.

You are responsible for ensuring you or your child are in adequate health to train, and for disclosing medical conditions, injuries, and allergies relevant to safe participation. You should consult a physician before beginning any new physical activity. Nothing on this website is medical advice.

Our website links to and embeds third-party services, including our payment processor, a live chat widget, and social media pages. We do not control those services and are not responsible for their content, availability, terms, or privacy practices. Your use of a third-party service is governed by that provider’s terms.

The website and its content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the website will be uninterrupted, timely, secure, or error-free, that schedule and pricing information will always be current, or that messages and calls will always be delivered. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

To the fullest extent permitted by law, White Tiger Dojo and its owner, instructors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of your use of this website, our text messaging program, or our AI voice assistant. Our total liability for any claim relating to the website or those communications services will not exceed the amounts you paid us in the twelve months before the claim arose. Nothing in this section limits liability that cannot be limited under applicable law, and this section does not affect the separate terms of any signed waiver or enrollment agreement, which govern liability for physical participation in classes.

You agree to indemnify and hold harmless White Tiger Dojo and its owner, instructors, employees, and agents from any claims, damages, losses, and reasonable legal fees arising out of your breach of these Terms, your misuse of the website or our communications services, or your provision of another person’s telephone number or personal information without their authority.

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of law rules. Subject to any binding arbitration provision in a waiver or enrollment agreement you have signed, you agree that the state and federal courts located in Union County, New Jersey have exclusive jurisdiction over any dispute arising out of these Terms or your use of this website.

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. Our failure to enforce a provision is not a waiver of it.

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Continuing to use the website or our services after an update means you accept the revised Terms. If a change materially affects your membership, we will notify you directly.
